  • Notify Facilitas promptly of any legal notices, violations, or changes in property ownership.

You acknowledge that Facilitas operates as a service provider and agent but does not assume ownership or legal responsibility for the property.

3. Service Fees and Payment Terms

Service fees are detailed in your Property Management Agreement. These may include:

  • A monthly management fee (typically a percentage of rent collected)
  • Leasing or tenant placement fees
  • Maintenance coordination or markups
  • Eviction processing fees (if applicable)

Payment of fees must be made on time, per the schedule outlined in your contract. If fees are not paid on time:

  • Late fees may be assessed
  • Services may be paused or terminated
  • Facilitas reserves the right to deduct owed amounts from any rent collected

All service charges will be disclosed and itemized in your monthly statement.

4. Communication and Documentation

Facilitas commits to maintaining transparent and documented communication. This includes:

  • Copies of leases and legal notices
  • Monthly statements and rent roll summaries
  • Maintenance and inspection reports
  • Records of all tenant communication

5. Maintenance and Repairs

Facilitas will coordinate all maintenance and repair work for managed properties using licensed vendors where applicable. Emergency repairs that pose a safety risk or prevent habitability will be addressed immediately, even without prior approval from the owner. Non-emergency repairs may require pre-authorization, depending on the limit set in the management agreement.

You are responsible for funding repairs and maintenance unless otherwise agreed. Facilitas is not liable for delays, substandard work, or damages caused by third-party vendors, although we will make reasonable efforts to ensure quality and timely service.

6. Tenant Management

Facilitas will handle all routine tenant interactions, including:

  • Lease signing and enforcement
  • Rent collection and payment reminders
  • Routine property check-ins
  • Notices for lease violations or non-payment

7. Use of Website

Our website and any associated online portals are intended for informational and administrative use. By using our digital services, you agree not to:

9. Limitations of Liability

While Facilitas makes every reasonable effort to provide excellent service, we cannot guarantee the actions or behavior of tenants, vendors, or third parties. Therefore, we are not liable for:

  • Loss of rental income
  • Property damage caused by tenants or contractors
  • Legal fees incurred due to tenant disputes or government action
  • Market downturns or economic conditions affecting rent or occupancy

10. Termination of Services

Either party may terminate the relationship as outlined in the Property Management Agreement. Common termination reasons include:

  • Sale of property
  • Client dissatisfaction
  • Failure to pay fees
  • Breach of contract

Upon termination, Facilitas will return all records, keys, and remaining funds (minus any unpaid balances) to the client within a reasonable time frame. A final accounting statement will be issued.

11. Dispute Resolution

Any disputes arising from these Terms or the management relationship will first be addressed through informal negotiation. If unresolved, the matter will be submitted to binding arbitration in the state where the property is located.

12. Changes to Terms

Facilitas reserves the right to update these Terms from time to time. We will notify clients of significant changes via email or through our website. Your continued use of services after the update indicates acceptance of the new Terms.
